DISTANCE SALES AGREEMENT

ARTICLE 1 - PARTIES

This Distance Sales Agreement ("Agreement") is concluded electronically between the Seller identified below and the Buyer placing an order through www.holiedress.com, in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

ARTICLE 2 - SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the Seller and the Buyer regarding the sale, payment, delivery, return and other conditions concerning the products ordered electronically through www.holiedress.com, in accordance with applicable Turkish consumer legislation.

ARTICLE 3 - PRODUCT INFORMATION

The following information is specified in the Order Summary and forms an integral part of this Agreement:

The Buyer confirms that all order information has been reviewed before completing the purchase.

ARTICLE 4 - PAYMENT

The Buyer agrees to pay the total purchase amount using one of the available payment methods offered during checkout.

Available payment methods may include:

Credit Card
Debit Card
Bank Transfer
Virtual POS
Other Electronic Payment Methods

Orders are processed only after successful payment authorization.

The Seller shall not be responsible for delays caused by banks, payment service providers or technical payment system failures.

ARTICLE 5 - DELIVERY

Orders are processed after payment confirmation.

Unless otherwise stated on the product page, products in stock will be prepared and delivered to Aras Kargo within a maximum of 5 business days.

Saturdays, Sundays and official public holidays are not considered business days.

Delivery is made to the address specified by the Buyer during checkout.

The Seller is not responsible for delays resulting from incorrect or incomplete delivery information provided by the Buyer.

ARTICLE 6 - SHIPPING

All shipments are delivered via Aras Kargo.

A shipment tracking number may be provided after dispatch.

The Buyer is advised to inspect the package upon delivery.

If the package appears:

damaged,
opened,
crushed,
torn,
wet,

the Buyer should request a damage report from the courier and immediately notify Holie Dress.

Failure to obtain a courier report shall not eliminate the Buyer's mandatory legal rights.

ARTICLE 7 - FORCE MAJEURE

The Seller shall not be liable for delays or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to:

Natural disasters
Earthquakes
Floods
Fires
Epidemics or pandemics
War
Terrorist acts
Government restrictions
Internet infrastructure failures
Electrical outages
Carrier strikes
Transportation disruptions

In such cases, delivery periods may be reasonably extended.

ARTICLE 8 - RIGHT OF WITHDRAWAL

The Buyer acting as a consumer has the right to withdraw from this Agreement within 14 days from the date on which the Buyer or a third party designated by the Buyer receives the goods.

The Buyer is not required to provide any reason and shall not incur any penalty.

The withdrawal notice must be sent to:

within the legal withdrawal period.

The notice should include:

ARTICLE 9 - EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal may not apply to:

Products manufactured according to the Buyer's personal specifications
Custom-made products
Tailor-made garments
Personalized products
Products altered upon the Buyer's request
Goods unsuitable for return due to hygiene reasons after opening
Other products excluded under applicable legislation

Trying on a standard ready-made dress solely to determine size and fit shall not, by itself, eliminate the Buyer's statutory withdrawal rights.

ARTICLE 10 - RETURNS

Returned products should be:

Unused beyond ordinary inspection
Unwashed
Unaltered
Free from perfume
Free from deodorant stains
Free from make-up marks
Free from damage
Returned with original labels
Returned with all accessories
Properly packaged

ARTICLE 11 - REFUNDS

Once the returned product has been inspected and approved, the purchase amount shall be refunded within the statutory period using the same payment method whenever technically possible.

The Seller is not responsible for delays caused by banks or payment institutions.

Where legally permitted, the Seller may postpone the refund until receiving the returned goods or proof that the Buyer has shipped them.

ARTICLE 12 - EXCHANGE

Product exchanges are subject to stock availability.

Before requesting an exchange, the Buyer should contact:

Alternative products
Another size
A refund

ARTICLE 13 - DEFECTIVE OR INCORRECT PRODUCTS

If the Buyer receives a product that is:

Defective
Incorrect
Damaged
Incomplete

the Buyer should notify Holie Dress together with the Order Number and photographs of the product where possible.

The Buyer's statutory rights under applicable consumer protection legislation remain fully reserved, including:

Termination of the Agreement
Replacement
Repair
Price Reduction
Refund

ARTICLE 14 - PERSONAL DATA

The Seller processes personal data in accordance with:

Turkish Personal Data Protection Law (KVKK)
Applicable Data Protection Legislation
Privacy Policy published on www.holiedress.com

Personal data are processed solely for purposes including:

Order Processing
Payment Processing
Shipping
Customer Support
Legal Obligations
Accounting
Fraud Prevention

ARTICLE 15 - EVIDENCE

The Parties agree that the following records shall constitute valid evidence in any dispute arising from this Agreement:

Website records
Electronic order records
Payment records
Server logs
Accounting records
Electronic correspondence
Digital system records

unless proven otherwise.

ARTICLE 16 - GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the Republic of Türkiye.

Consumer disputes shall be resolved by the competent Consumer Arbitration Committees and Consumer Courts in accordance with the monetary limits and jurisdiction rules established by Turkish legislation.

ARTICLE 17 - EFFECTIVENESS

By completing the order electronically, the Buyer declares that they have read, understood and accepted:

This Agreement becomes effective immediately upon electronic confirmation of the order.
